Good afternoon, everyone, and welcome back to “Legal Ease.” Today we have the pleasure of speaking with Ted Cook, a probate attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with us.
So, Ted, let’s jump right in: What exactly is probate?
It’s a common question folks have. Simply put, probate is the legal process of administering a deceased person’s estate. Think of it as tying up all the loose ends: validating the will (if there is one), identifying and valuing assets, paying off debts, and ultimately distributing what remains to the rightful heirs.
What are some key steps involved in this probate process?
Well, the process has several distinct stages. First, we need to determine if probate is even necessary. California law sets a threshold; if the estate’s value is below $184,500, probate might be avoidable.
If probate is required, we file a petition with the court, usually naming an executor or administrator. Then comes notifying heirs, beneficiaries, and creditors. We also have to gather and inventory all the estate’s assets. Paying off debts and filing taxes are crucial steps. Finally, we prepare a detailed accounting for the court’s approval before distributing the remaining assets.
Speaking of paying debts, what challenges might arise during that stage?
Ah, debt management can be tricky! Sometimes, creditors emerge with claims that are difficult to verify. Other times, the deceased may have outstanding loans or credit card debt that we weren’t initially aware of.
- “It’s like detective work,” Ted explains, leaning back in his chair. “We need to carefully review financial records, contact institutions, and sometimes even hire forensic accountants to trace down all debts.”
- He adds with a chuckle, “I once had a case where a long-lost credit card bill surfaced just as we were about to distribute the assets. Talk about a surprise!”
Let’s shift gears and talk about client experiences. Can you share any feedback about your work?

In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
