Let’s dive right in. Many people aren’t familiar with the process, so could you explain one of the first crucial steps?
The Probate Process Begins
Steve: Absolutely. One of the initial and most important considerations is whether probate is even necessary. This hinges on a couple of factors. First, we need to assess the total value of the deceased person’s estate. In California, if the gross value of the estate exceeds $184,500, probate will likely be required.
Conversely, estates valued below this threshold may qualify for simplified procedures or even avoid probate altogether. The second factor involves identifying assets that pass outside of probate. These are assets held in trusts, jointly owned property with rights of survivorship, or beneficiary-designated accounts. Such assets transfer directly to the designated individual or entity, bypassing the probate court.
Accordingly, a thorough inventory of all assets is essential. We carefully review titles, deeds, account statements, and other relevant documents to determine which assets fall under probate jurisdiction and which can be distributed outside of this process. This analysis helps streamline the overall probate procedure and minimize unnecessary costs and delays.
Navigating Complexities
It’s not uncommon for us to encounter situations where determining whether probate is needed presents unique challenges. For example, I remember a case involving a family business. While the deceased individual had a will, the business was structured as a sole proprietorship.
Consequently, the entire value of the business assets became part of the probate estate, pushing it over the threshold for requiring probate proceedings even though other assets were relatively modest. This highlighted the importance of carefully considering all aspects of an individual’s financial holdings when making this initial determination.
