If there’s a valid will, we submit that along with the petition. The court reviews the petition, and if everything is in order, they issue Letters Testamentary (for an executor appointed by a will) or Letters of Administration (when there’s no will).
Ordinarily, this step goes smoothly, but occasionally we encounter complications. For instance, I once had a case where the family couldn’t locate the original will. It turned out to be tucked away in a safe deposit box that nobody knew about! After some diligent searching and paperwork, we were able to retrieve it and proceed with the probate process.
