Probate Basics: Making Sense of the Process
Steve, for our viewers who may not be familiar with probate, can you give us a brief overview of what it is and why it’s often necessary?
“Probate is essentially a legal process that occurs after someone passes away. It involves validating their will (if one exists), identifying and inventorying their assets, paying off debts and taxes, and ultimately distributing the remaining property to their heirs or beneficiaries,” Steve explains.
“Not every estate goes through probate. Ordinarily, if the total value of a person’s assets falls below a certain threshold, which in California is currently $184,500, probate may be unnecessary. Additionally, assets held in trusts or jointly owned property often bypass probate.”
Diving Deep: Marshaling Estate Assets
Steve, today we want to delve into one specific step of the probate process: marshaling estate assets. Can you walk us through what this entails?
“Marshaling estate assets is a crucial stage in probate,” Steve begins. “It involves meticulously identifying and inventorying all of the deceased person’s assets. This includes everything from bank accounts and real estate to vehicles, personal property, and investments.”
“Once we have a complete list, we then need to determine their value. This often requires appraisals for items like real estate or art collections. All this information is compiled into a formal document called an Inventory and Appraisal, which is filed with the court.”
Steve emphasizes the importance of thoroughness during this stage: “Accuracy is paramount. Any omissions or misvaluations can lead to complications later in the probate process. Consequently, it’s essential to work with experienced professionals who understand the intricacies of asset valuation.”
“Moreover,” Steve adds, “we need to be aware of potential hidden assets. Sometimes, individuals have accounts or investments that they haven’t disclosed to family members. Uncovering these assets can be challenging but is crucial for ensuring a fair and complete distribution of the estate.”

Steve, I imagine there are times when marshaling assets presents unique challenges?
“You’re absolutely right,” Steve says, leaning forward. “I recall one case where the deceased had been a collector of rare coins. Tracking down the entire collection, verifying their authenticity, and obtaining accurate appraisals took months. It was painstaking work, but ultimately we were able to ensure that these valuable assets were properly accounted for and distributed according to the client’s wishes.”
“Another instance involved a family who was unaware of a significant life insurance policy. Through diligent research and communication with various institutions, we were able to locate the policy and secure a substantial benefit for the beneficiaries. These moments remind me why I do this work – helping families navigate complex situations and achieve a sense of closure.”
