Can you walk us through the general probate process?

Ted lays out a clear roadmap: “The probate process begins with determining if it’s even necessary. That depends on the value of the estate and whether there are assets outside of probate, like trusts or jointly owned property.” He continues, “If probate is required, we file a petition with the court, provide notice to heirs and creditors, and then attend a hearing where a judge appoints an executor or administrator.

“Next comes marshaling the estate’s assets – taking inventory, appraising them, and addressing any outstanding debts or taxes. Finally, we distribute the remaining assets to the beneficiaries according to the will or state law.”

“This step requires meticulous attention to detail,” explains Ted. “First, we need to identify all valid creditor claims. Sometimes, creditors emerge unexpectedly after the deceased has passed, so thorough research is crucial. We prioritize paying these debts and then turn our focus to filing any necessary tax returns – both state and federal.”
